The following terms govern the sale of products listed on this website by LÉKUÉ, S.L., with registered office in C/ Barcelona, 16, 08120 La Llagosta (Barcelona‑Spain), registered in the Mercantile Registry of Barcelona, Volume 28,846, Folio 125, page B-144290 and Tax ID number B-61059754 (hereinafter LÉKUÉ), to the customer or user (hereinafter the Customer or USER) as well as the use thereof. By browsing on the online shop and purchasing any products listed, the user accepts, with no reservations of any kind, each and every one of these general terms and conditions. Nevertheless, should you have any questions about the terms, please do not hesitate to contact Customer Care.
LÉKUÉ may at any time and without notice amend these general terms and conditions, as well as any special conditions included, by posting these amendments on the store for users’ information. The date of these modifications will remain on record and all laws and regulations in force will be complied with at all times. The products offered on this website, and specifically the prices, specifications, promotions and any other information may change without notice.
1. Ownership of the Website Content.
All content published in the store, and especially designs, text, graphics, photographs, images, logos, icons, buttons, as well as software, trade names, trademarks or industrial drawings and any other symbols subject to industrial and commercial use are considered LÉKUÉ’s intellectual property and under copyright, and are the exclusive property of LÉKUÉ. Under no circumstances shall it be understood that LÉKUÉ grants any licence whatsoever or issues any waiver, transfer (total or partial) of such rights, nor any right or expectation of rights conferred, in particular for the alteration, exploitation, reproduction, distribution or public communication of these contents without prior express authorization from LÉKUÉ.
LÉKUÉ shall not be liable, in any case and under any circumstances, for violations of such rights committed by the USER.

Items offered on this website are products from the LÉKUÉ collection and meet the same quality and warranty requirements as products offered for sale in retail outlets.

* LÉKUÉ has made an effort to display product colours as close to reality as possible. Nevertheless, the colour of products shown on screen may vary depending on the quality of your computer monitor. LÉKUÉ can therefore not guarantee that the colour of the product you receive matches exactly the colour shown on your screen.

5. Purchase Procedure
You may proceed to checkout as a registered user or, if you prefer, as a guest. Simply fill out the electronic form that appears in the store and follow its instructions. Once you register, and to proceed with your purchase, you must add the product you wish to purchase to the cart, according to the on-screen instructions. Fill out and confirm the order form. By confirming the order, the client expressly undertakes to know and accept these General Terms and Conditions as part of the contract.
Select the items you wish to purchase and add them to the shopping cart by clicking on the corresponding icon. The shopping cart will show the part number of the selected item, its name and price in euros (with the approximate value in your currency, for information purposes only). Applicable taxes will be detailed separately in addition to the shipping charges that may apply depending on your destination country.
If we are out of stock on a specific item, we will notify you promptly when you add the item to the shopping cart, so you can decide if you want to wait up to 15 days for delivery or prefer not add the product to the basket. In the event that you include the item in the basket, LÉKUÉ will not charge you for the entire order until this item becomes available, since we do not process partial deliveries.
The order form will request your personal data, which will be added to our database in order for LÉKUÉ to process your order and allow you to continue shopping on the site. You may access your personal data and track all your orders. Remember that your personal data must be entered accurately to avoid confusion or issues with the shipping of items purchased. Furthermore, should you request it, you will receive LÉKUÉ information and publications by post and/or e-mail.
Once the order is completed and prior to shipping, a summary will be issued listing the item purchased, the total price (including transport and taxes) and shipping details. The order must be confirmed by clicking the "Confirm Order" button.
5.2 Pricing and Currency
All prices published by LÉKUÉ in the shop include indirect taxes (Value Added Tax), if you specified an EU country in your shipping address in the initial settings.
As a general rule, the Value Added Tax applicable for the territory of the European Union where this tax applies will be the current tax rate in Spain. Companies in EU countries, except Spain, shall be exempt from paying this tax.
LÉKUÉ, S.L. presents and sells the products in euros. However, USERS will be able to see the approximate equivalent of prices in their local currency, for information purposes only.
5.3 Payment Method
Purchases are paid by secure credit card or debit cards (VISA, MASTERCARD, MAESTRO), and PayPal. No other forms of payment are accepted.
Credit card or debit card payments will be online, i.e., in real time, through the Adyen payment gateway, once the information provided is vetted. When the transaction is confirmed, the order number will be communicated on the website itself so users can track their order from their computers at all times. Likewise, users will receive an e-mail message with the description of their order and personal details reported. Failure to receive this message may be due to a temporary communications problem on the network or a typo in the e-mail address provided. In both cases, it is advisable for you contact Customer Care.
Specifically, LÉKUÉ offers the following payment methods:
a) VISA, MASTERCARD, MAESTRO Credit Cards
We guarantee that every transaction made by LÉKUÉ is 100% secure. All operations involving the transfer of personal or banking data occur in a secure environment. LÉKUÉ uses a server based on standard SSL (Secure Socket Layer) technology. All information you send us travels encrypted through the network, and your credit card data are not registered in any database but go directly to the POS (Bank Point of Sale).
Likewise, please note that, in an effort to provide greater security to credit card users, we have incorporated the SEC (Secure Electronic Commerce) system into our payment gateway.
What is SEC (Secure Electronic Commerce)? SEC is a system for secure online transactions promoted by Visa International, MasterCard, Microsoft and Netscape, among others. The main purpose is to give greater security to Internet users as well as merchants selling online when it comes to authenticating the buyer as the legitimate holder of the card being used.
If you have not yet received a personal password used exclusively for online payments, we suggest you ask your financial institution to link your cards to the Secure Electronic Commerce system.
We will always request the following about your VISA, MASTERCARD OR JCB: card number (PAN), expiry date and a validation code (CVV), which is the last 3 digits of the number printed in italics on the back of your card, thus offering enhanced security for the transaction.
Once you enter your data, the operation is sent to the card issuer, who confirms the authentication of the operation. The card issuer therefore checks the card holder’s authenticity. We must receive payment in advance before your order can be processed and the goods can be dispatched, unless we have agreed otherwise in advance in writing.
IMPORTANT NOTE: Even if you do not have a secure credit card, you can also pay with your credit card on Paypal, which offers the option of paying by credit card, in a process that is easy and immediate.
PayPal allows consumers to make payments online securely, easily and cost-effectively. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global payment solution in real time.

5.4 Order Delivery. Shipping Fees.
The price of products will be as stipulated at all times on our website.
All prices are listed in Pounds (£) on your Uk website. The prices listed on the website include 20% VAT, exclude shipping costs.
Prices may change at any time, but will not affect orders for which we have already sent a shipping confirmation.
Items purchased at LÉKUÉ will be delivered through a courier company. Delivery times are generally a maximum of 3 working days. Such turnarounds may vary depending on the specific circumstances of each order, such as product availability and shipping area. Also, under exceptional circumstances, that period may be affected by extraordinary carrier incidents or difficulties in delivering the goods. In these cases, the delivery time can be up to 7 working days.
To avoid delivery issues (incorrect addresses, no one found at home etc.), the shipping form must be completed accurately and telephone contact information must be included.

LÉKUÉ’s responsibility is limited in cases of force majeure (strikes, adverse weather conditions hindering normal traffic by land, sea or air, etc.). In these cases, LÉKUÉ will deliver the orders as soon as possible and the above limits will not apply.
Our carriers attempt delivery up to three times at the address provided by the customer during normal working hours (9 am to 6 pm). It is the customer’s responsibility to be present at the delivery address provided to LÉKUÉ. In the event that delivery cannot be made for failure to find the customer at the specified address, the carrier will return the package to the sender and LÉKUÉ will refund the order amount, deducting any costs associated with the return.
6. Purchase Limit
LÉKUÉ does not allow the purchase of LÉKUÉ products for resale. Purchases for over 500 euros (£) (or equivalent amount in the relevant currency) or for more than 20 items are therefore not accepted. Customers who are interested in making purchases exceeding that amount or item quantity for purposes other than resale must contact LÉKUÉ through email@example.com where they will be informed of the various options available for making the desired purchase.
Your product guarantee, required for any exchange or refund, is the delivery note you will receive with your order and/or by e-mail, and it is valid for two years.
The warranty does not cover wear and tear or other results of normal ageing of the item or damage caused by misuse.
8. Right of Withdrawal
You are entitled to withdraw from this contract within 14 calendar days without need for justification.
The withdrawal period will expire after 14 calendar days from the day you or a third party indicated by you, other than the carrier, has acquired the physical possession of the goods.
To exercise the right of withdrawal, you must notify LÉKUÉ S.L., registered office in C/ Barcelona, 16, 08120 La Llagosta (Barcelona, Spain), phone 93 574 26 40, storeUK@lekue.com, of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or e-mail). You may optionally use the withdrawal form below.
To meet the withdrawal period, it is sufficient that your communication concerning the exercise of your rights is sent before the expiry of the deadline.
Effects of withdrawal
In the event of withdrawal, we will refund all payments received from you, including shipping costs (with the exception of the additional costs for delivery options other than the standard, least expensive shipping method we offer) without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will issue the reimbursement using the same payment means you used for the initial transaction, unless you have expressly specified otherwise. In any event, you will not incur any reimbursement-related fees. We may withhold reimbursement until we receive the goods or until you provide proof of return, whichever condition is met first.
The right of withdrawal will not be applicable to contracts that refer to:
a) The supply of goods prepared in accordance with the specifications of the consumer and user or clearly personalized.
b) The supply of goods that may deteriorate or expire quickly.
c) The supply of presealed goods that are not suitable to be returned on grounds of the protection of health or hygiene and whose seals have been broken after delivery.
You must return or deliver goods directly at... The deadline will be considered as met if you send back the goods before the period has ended. You must bear the direct cost of returning the goods.
Only you are responsible for the diminished value of the goods resulting from handling them in a way other than what is strictly necessary to establish the nature, characteristics and operation of the goods.

LÉKUÉ is thus committed to not carrying out false advertising. Formal or numeric errors in the content of the various sections of our online store cannot be considered false advertising when resulting from incomplete or faulty maintenance and/or updating of information in these sections. Pursuant to the provisions of this paragraph, LÉKUÉ undertakes to correct any errors as soon as it becomes aware of them.
Users who sign up through the online shop declare they are of full legal age. Purchases carried out by minors requires prior authorization from parents, guardians or legal representatives, who will be held liable for purchases made by the children in their care. Minors must obtain the necessary consent prior to making any purchases.
10. Law and Applicable Jurisdiction
These purchase conditions are subject to the Spanish legislation, so sales transactions are deemed to be performed in LÉKUÉ’s registered office.
To resolve any dispute arising from this contract or legal instrument, the parties may apply to the Consumer Arbitration Board of Catalonia, who is entrusted with the appointment of the arbitrator(s) and the arbitration committee. In the event that none of the above systems proves effective, both parties submit to the Courts of Barcelona, waiving their own jurisdiction, if other. In case of disputes with end consumers residing in Spain, the parties submit to the Courts nearest the consumer.
